The philosophy of the faculty at Truman promotes one-to-one interaction and an “open door” office policy. Truman’s faculty displays a strong commitment to quality teaching and to serving as positive role-models in and out of the classroom. Our limited enrollment allows for an approximate 16:1 student/teacher ratio with over three-fourths of our full-time faculty holding doctorates or terminal degrees. Approximately 95 percent of our freshman classes are taught by regular faculty who represent most major graduate institutions in the United States and several graduate institutions abroad. Students, faculty, and staff share the primary responsibility to maintain the highest standards of academic integrity. Unauthorized distribution of copyrighted material, including unauthorized peer-to-peer file sharing, may result in civil and criminal liabilities.
Copyright infringement is the act of exercising, without permission or legal authority, one or more of the exclusive rights granted to the copyright owner under section 106 of the Copyright Act (Title 17 of the United States Code). These rights include the right to reproduce or distribute a copyrighted work. In the file-sharing context, downloading or uploading substantial parts of a copyrighted work without authority constitutes an infringement.
Penalties for copyright infringement include civil and criminal penalties. In general, anyone found liable for civil copyright infringement may be ordered to pay either actual damages or “statutory” damages affixed at not less than $750 and not more than $30,000 per work infringed. For “willful” infringement, a court may award up to $150,000 per work infringed. A court can, in its discretion, also assess costs and attorney’s fees. Willful copyright infringement can also result in criminal penalties, including imprisonment of up to five years and fines of up to $250,000 per offense. In addition, members of the University community who engage in any activity that infringes copyright-protected materials may be subject to disciplinary action.
Use of University computing resources and facilities requires that individual users act in compliance with the University policies and procedures as detailed in the Student Code of Conduct, the Staff Handbook, and the Faculty Handbook. In accordance with applicable state and federal regulations Peer-to-peer file sharing is limited to a percentage of a user’s available bandwidth and collectively to a percentage of the University’s overall bandwidth.
